Cowlitz County

Drug Court is a Cowlitz County Superior Court program that offers participants the chance to enter treatment for drug/alcohol addiction, and have their current charge dismissed if the program is successfully completed. The goal of Drug Court is to stop criminal activity associated with drug and alcohol use. The program is available to persons who have admitted problems with drugs/alcohol and have been charged with an eligible offense.

Participant Eligibility:

  • Possession of Controlled Substance (not with intent to manufacture or deliver)

  • Forged prescription

  • Theft in the First or Second Degree

  • Forgery and Unauthorized Issuance of Back Checks

  • Burglary in 2nd Degree

  • Misdemeanor Theft and Malicious Mischief

Ineligible Offenses:

  • Violent offenses per RCW 9.68A

  • Sex Offenses per RCW 9.68

  • Obscenity/Pornography offenses per RCW 9.68A

  • Sexual exploitation of children per RCW 9.68 or Communicating with a minor for immoral purposes, indecent exposure, allowing a minor on premise of a live erotic performance

  • A history of domestic violence convictions

  • Residential burglary, illegal possession of or use of a firearm, theft of a firearm or possession of a stolen firearm

  • Any offense, felony or misdemeanor, which include a finding of sexual motivation

Prior Juvenile Offenses: The following juvenile prior convictions would disqualify the defendant from participation in Drug Court:

  • Violent offenses per RCW 9.68A

  • Sex Offenses per RCW 9.68

  • Obscenity/Pornography offenses per RCW 9.68A

  • Sexual exploitation of children per RCW 9.68 or Communicating with a minor for immoral purposes, indecent exposure, allowing a minor on premise of a live erotic performance

  • Any Class A felony

  • Residential burglary, illegal possession of or use of a firearm, theft of a firearm or possession of a stolen firearm

  • Any offense, felony or misdemeanor, which include a finding of sexual motivation

Graduation Requirements:

  • Successful completion of all treatment requirements

  • Six drug/alcohol free months 

  • A combination of work and/or school 

  • Fulfillment of financial obligations 

  • Approval for graduation by Drug Court Team
